AN ACT to progressively repeal the provisions of the Enterprise Incentives and Export Promotion Act 1992/1993.

BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-

1. Short title and commencement - (1) This Act may be cited as the Enterprise Incentives and Export Promotion Repeal Act and shall be read together with the Enterprise Incentives and Export Promotion Act 1992/1993 (the "principal Act").

(2) This Act shall come into force on the date it is assented to by the Head of State (the "commencement date").

2. Immediate repeals - The Parts and Sections of the principal Act specified in the Schedule are hereby repealed.

3. Deferred repeals - All sections of the principal Act not specified in the Schedule shall be deemed to be repealed upon the termination, in accordance with the principal Act or the terms of any approval order given prior to the commencement date, of the last right to a benefit given to enterprises under the principal Act.

4. Transitional and savings - (1) Any power exercisable by the Board under any section to which section 3 of this Act relates, may be exercisable by the Minister responsible for Trade, Commerce and Industry after the commencement date and until the final repeal of the principal Act.

(2) The repeal of the principal Act shall not affect any prosecution, current or pending, for an offence against the principal Act, or an obligation on the part of any enterprise to repay any benefit to which it was not lawfully entitled.
